Subscriptions Terms and Conditions

The following terms and conditions constitute a legally binding contract (the “Agreement”) that governs the “TAJINE QUI PARLE” Subscription Services provided by RICHELE SANCHEZ (EI), trading as TAJINE QUI BRILLE FRANCE (“we”, “our”) to you (“you”, “your”).

Our Subscription Services are offered subject to your acceptance without modification of all of the terms and conditions contained herein. We also have other policies and procedures, including our Privacy Policy. Those policies contain additional terms and conditions, which apply to our subscription services and are an integral part of this Agreement.

YOUR USE OF THE “TAJINE QUI PARLE” SUBSCRIPTION SERVICES CONSTITUTES YOUR ACCEPTANCE OF AND AGREEMENT TO BE BOUND BY THIS AGREEMENT.

1. The “TAJINE QUI PARLE” subscription services

Our Subscription Services provide access to additional features such as audio content through a paid plan (“Paid Subscription”). Details of the features and content included in our subscriptions are available on our website, tajinequiparle.com. To access these features, you must purchase a Paid Subscription.

We reserve the right to modify, terminate, or otherwise amend the features, plans, and promotional offerings associated with our Subscription Services at any time.

When you purchase a Paid Subscription, you will have access to the content and features included in that plan for the duration of your subscription term. We may periodically update the Subscription Services, which may result in changes to the availability of specific features or content.

2. Access to subscriptions and eligibility

Our Subscription Services are available to users who have registered their accounts truthfully, providing all required personal information. Accounts containing false information may be terminated. You agree to take full responsibility for your selection and use of our Subscription Services.

Users must be at least 18 years old or have parental consent to register. By registering, you confirm that you meet these eligibility requirements.

We may change, modify, suspend, or discontinue our subscriptions, fees, charges, and terms at our discretion at any time, including the availability of any feature or content. We may also impose limits on certain features or restrict access to parts or all of our Subscription Services without notice or liability.

3. Using our Subscription Services

Our Subscription Services and any features or content made available through the service are the property of TAJINE QUI BRILLE FRANCE. By purchasing a Paid Subscription, you are granted limited, non-exclusive, non-transferable, and revocable permission to access and use the Subscription Services and its features and content for personal use only.

This access remains valid until your subscription period ends or your Paid Subscription is terminated by you or us.

You are solely responsible for keeping your account password secure and ensuring that no third parties access or use your subscription services. Sharing accounts is prohibited. Notify us immediately of any breach of security or unauthorized use of your account.

4. Access to audio content with our audio subscriptions

Subscribers with an active Paid Subscription have access to audio content on the site, where available. Not all pages or dictionary entries include audio.

Audio can be streamed an unlimited number of times during the active subscription period by clicking the orange speaker icon (where provided). Access to audio content ceases when the Paid Subscription expires unless it is renewed.

Audio files are not downloadable for offline use and can only be accessed when connected to the site. Simultaneous playback on multiple devices is prohibited.

5. Quality of audio content

We strive to provide high-quality audio content by using professional equipment and editing techniques. However, we cannot guarantee that the quality will always meet your specific expectations.

Delays may occur when playing audio (between first clicking on the speaker icon and hearing the audio), particularly on mobile devices. This delay is generally reduced on subsequent attempts to play the same audio file. If you encounter any other issues with audio playback, we are committed to investigating and resolving them promptly to minimize disruptions.

6. Interruptions to our service (downtime)

We cannot guarantee 100% uptime. During downtime, audio will not be accessible. This may occur for the following reasons:

  • Server maintenance: Our hosting provider may perform maintenance on their servers, temporarily making the site unavailable. This is typically infrequent and usually lasts less than two hours.
  • Site maintenance: We may put the site into maintenance mode for updates or improvements. We aim to minimize the frequency and duration of these interruptions.
  • Technical errors: Rare technical issues may cause temporary unavailability. We will resolve such issues as quickly as possible.

In the case of prolonged downtime, we may consider compensating affected subscribers with additional subscription time.

7. Payment

Payments for subscriptions can be made via credit or debit card. If you cannot pay using these methods, contact us to discuss alternatives.

Payments are processed immediately via a third-party payment processor over a secure link. No card details are stored directly by us (the third party payment processor uses a method called “tokenization” to keep your card details secure even when you choose to save your payment details for future purchases).

After payment, you will receive a confirmation e-mail and a downloadable receipt available in your “My Account” section on our site.

Payments are processed in Euros (€). Users outside the Eurozone may incur currency conversion fees from their payment provider.

8. Cancellation and Refunds

By subscribing, you agree to the immediate provision of digital content, thereby waiving your right to the 14-day cancellation period under EU law, in accordance with the Consumer Rights Directive exception for digital services.

You may cancel your subscription at any time by contacting us. However, refunds are not provided for cancellations unless a verified technical issue on our website prevents access to audio content. This issue must be confirmed as originating from our website and not related to your device, speakers, or internet connection, as verified by us. In such cases, if we are unable to resolve the issue, we will provide a prorated refund for the remaining time (the unused portion) on your subscription.

Refunds will not be provided if the quality of the audio recordings does not meet your personal expectations. We strive to deliver high-quality audio but cannot guarantee subjective satisfaction. We recommend using the free membership to evaluate the system and audio quality before committing to a paid subscription.

9. Communications and Notifications

By subscribing to the TAJINE QUI PARLE Subscription Services, you consent to receiving email communications from us. These emails will include updates about new features, service improvements, important account information, and notifications of changes to our Terms and Conditions. You may opt out of receiving promotional emails at any time; however, we reserve the right to send non-promotional communications related to your subscription.

10. Subscription Continuity for Long-Term Plans

For long-term subscriptions, such as 5-year plans, we are committed to maintaining and updating the service regularly. Subscribers will receive updates about new features, improvements, or any changes that may affect their subscription.

We make every effort to ensure the continuity of our Subscription Services. However, in the event of unforeseen circumstances beyond our control, including but not limited to illness, incapacity, or death of the site owner, we may be unable to continue maintaining the site or providing subscription services.

In the event that the Subscription Services are permanently discontinued due to unforeseen circumstances, including but not limited to the illness, incapacity, or death of the site owner, no refunds can be guaranteed. We encourage you to consider the potential risks associated with long-term subscriptions before purchasing a subscription.

11. Limitations of Liability

Our subscription services are provided “as is,” without any warranties (express or implied). Use our services at your own risk. We do not guarantee specific outcomes or uninterrupted availability.

Our liability is limited to the amount paid for the subscription. We are not responsible for indirect damages or events beyond our control, including force majeure events (e.g., natural disasters, technical failures). This limitation does not affect any rights you may have under applicable consumer protection laws.

12. Governing Law and Dispute Resolution

This Agreement is governed by the laws of France. Any disputes arising under this Agreement will be subject to the exclusive jurisdiction of the courts in France, regardless of the user’s location. This does not limit any rights you may have as a consumer under the laws of your country of residence.

13. Effective Date and Updates

These Terms and Conditions were last updated on 22 January 2025 and supersede any previous versions.

We reserve the right to review, update, and amend these Terms and Conditions at our sole discretion. Any changes will be effective upon posting on our website. By using the TAJINE QUI PARLE Subscription Services, you confirm that you are aware that the current Terms and Conditions are available to view on the website.

We will inform all active subscribers of any significant updates to these Terms and Conditions via the email address provided in their account. Notifications will be sent at least 7 days before the updated Terms and Conditions come into effect. Continued use of the TAJINE QUI PARLE Subscription Services after receiving such notification constitutes your acceptance of the revised Terms and Conditions.
