The following terms and conditions apply to the creation, submission and/or delivery of any advertising or other commercial or sponsored content on the “Tajine qui parle” website.
Any order for the insertion of advertising on the “Tajine qui parle” website constitutes unreserved acceptance of the following terms and conditions.
“Advertising Services” means the creation, submission and/or delivery of any advertising or other commercial or sponsored content on the “Tajine qui parle” website.
“Advertiser” means the person or company identified in the Insertion Order.
“Ad” means an advertisement to be placed on the “Tajine qui parle” website.
“Advertising Campaign” means the placement of advertisements on the “Tajine qui parle” website for the duration specified in the Insertion Order.
“Insertion Order” means the advertising order agreed between the Advertiser and TAJINE QUI BRILLE (SARL) in relation to the Advertising Campaign.
2. The Advertiser’s Warranties and Responsibilities
The Advertiser warrants that the Ads shall not contain, promote or link to:
(a) pornographic or sexually explicit materials;
(b) obscene language or materials;
(c) hate material;
(d) materials that promote, endorse or support violence, the use of firearms, terrorism of any kind or discrimination based on race, sex, religion, nationality, disability, sexual orientation, age, or family status;
(e) any information that is inaccurate, false or misleading;
(f) materials that breach any contract or infringe or violate any copyright, trademark or any other personal or proprietary right of any person
(g) illegal content, including pirated music websites and illegal content streaming; or
(h) any other materials deemed harmful to the reputation of the “Tajine qui Parle” website or TAJINE QUI BRILLE (SARL).
The Advertiser will ensure that Ads comply with all applicable laws, regulations and guidelines. Failure to comply may result in a variety of consequences, including the removal of the Ad and cancellation of the Advertising Campaign.
TAJINE QUI BRILLE (SARL) reserves the right to reject or remove the Ad or require the Ad to be amended if it is deemed inappropriate or if it does not comply with the Terms or any applicable laws or regulations.
TAJINE QUI BRILLE (SARL) is hereby granted by the Advertiser worldwide non-exclusive, rights to reproduce and display each Ad (including all contents, names, trademarks, logos and brand features contained therein) in accordance with the Insertion Order and the provisions of these Terms.
The Advertiser will provide all materials for the publishing of the Ad on the Website as set out in the Insertion Order, in accordance with any instructions, technical requirements or other specifications of TAJINE QUI BRILLE (SARL). TAJINE QUI BRILLE (SARL) will not be required to publish any Ad that has not been received in accordance with any such instructions or requirements.
3. Ad performance
TAJINE QUI BRILLE (SARL) does not guarantee the reach or performance that Ads will receive, such as the number of people who will see the Ads or the number of clicks the Ads will get or the number of sales of that will result from the Advertising Campaign.
The number of pageviews per month or visitors per day to the “Tajine qui parle” website is not a guarantee of the number of Ad views or clicks. The Advertiser confirms awareness of and accepts the following factors affecting Ad performance:
(a) Rotation of Ads: Up to 10 Ads can occupy the same Ad space and will appear at random when each new page is loaded. The system of rotation is handled by a third-party plugin and cannot be modified by TAJINE QUI BRILLE (SARL).
(b) Position of Ad: If the position is below the fold on a page, the visitor may only view the Ad if they scroll down to the Ad position.
(c) Pages with Ads: Ads do not appear on all pages. Ads appear on Moroccan Arabic dictionary entries and on pronunciation and grammar pages, however Ads do not appear on other pages e.g. Landing pages and account pages, etc.
(d) Paid subscriptions: Ads do not appear for paid subscribers when they are logged into their account.
(e) Ad blocking software: Some Ad blocking software on some internet browsers might prevent the Ad from appearing on the website for some visitors.
(f) Website downtime: TAJINE QUI BRILLE (SARL) does not guarantee 100% website uptime and during the times when the “Tajine qui parle” website is down (not available to connect to), visitors will not be able to view pages and will not be able to view or click on Ads. This may be due to server maintenance by our hosting provider, website maintenance, or technical errors due to third-party plugin compatibility issues, etc.
(g) Ad design: The general design of an Ad will have an effect on the number of clicks.
(h) Ad content: The images and wording in the Ad will have an effect on the number of clicks.
(i) Ad relevance: The relevance of the product or service to the site’s visitors will have an effect on the number of clicks.
Invoices are issued by TAJINE QUI BRILLE (SARL) on receipt and acceptance of the Insertion Order, including acceptance of the Advertising Materials.
The Ad will be placed on the Tajine qui parle website, after the Advertiser has paid the full invoiced amount and payment has been received in the Tajine qui Brille SARL bank account. The Advertising Campaign will start on the date requested in the Order, if the date falls after payment has been received. TAJINE QUI BRILLE (SARL) reserves the right to suspend the start date of the Advertising Campaign until such time as payment is made in full.
TAJINE QUI BRILLE (SARL) reserves the right to cancel the Insertion Order if payment isn’t made within 30 days.
If TAJINE QUI BRILLE (SARL) fails to publish the Ad on the “Tajine qui Parle” Website (or in the event of any other failure of such Ad to appear as provided for in the Insertion Order), Tajine qui brille SARL’s liability will be limited (at the option of TAJINE QUI BRILLE (SARL)) to either:
(a) publishing the Ad (or a replacement Ad if provided by the Advertiser) as soon as is reasonably practicable following the period during which the Ad was scheduled to run; or
(b) refunding to the Advertiser that proportion of the amounts paid which relate to the Ad which were not provided.
6. These Terms and Conditions
These Terms and Conditions were last updated on 29 January 2023 and supersede any previous version of these terms and conditions.
TAJINE QUI BRILLE (SARL) reserves the right to review, update and amend its Terms and Conditions as and when it sees fit and the Advertiser confirms that they are aware that these Terms and Conditions are available to view on the Website. The continued use of the “Tajine qui parle” Advertising Services constitutes acceptance of any variation to the Terms and Conditions.
